1. Introduction and Acceptance
  • These Terms and Conditions (“Terms”) govern the sale of the battery product (“Product”) by GGB Battery India Pvt Ltd. (“Seller”) to the purchaser (“Buyer” or “you”).
  • By placing an order, you agree to these Terms.
2. Product Suitability and Installation
  • Suitability: The Buyer is solely responsible for ensuring the Product is technically suitable for their intended application and is compatible with their device/system.
  • Installation: Installation of the Product must be performed by a qualified, authorized professional strictly in accordance with the Product manual and all applicable Indian safety standards and regulations (e.g., BIS standards). Failure to comply will void the warranty.
3. Pricing, Orders, and Payment
  • Payment Methods: Payment is accepted via UPI or Credit Card. Payment must be received and confirmed before order acceptance and dispatch.
  • Order Acceptance: We reserve the right to accept or decline any order at our discretion.
4. Shipping and Delivery
  • Shipping Costs: The Seller is responsible for the shipping costs for the initial delivery of the Product within India.
  • Risk of Loss: Risk of loss and title for the Product pass to the Buyer upon delivery to the common carrier.
  • Inspection Period: The Buyer must inspect the Product for any physical damage or shortages and report any issues to the carrier and the Seller within 7 business days of delivery. Claims made after this period may be rejected.
5. Limited Warranty
  • Warranty Period: The Product is warranted against defects in materials and workmanship for a period of 2 years from the date of purchase (“Warranty Period”).
  • Coverage: This warranty is strictly limited to manufacturing defects in the Product. The Seller will, at its sole discretion, repair or replace the defective Product.
  • Warranty Voidance and Exclusions: The warranty shall be immediately void and does not cover the following:
    • Normal Capacity Degradation: The natural and gradual loss of battery capacity (state of health) over time and use.
    • External Damage: Physical damage, breakage of container/terminals, or damage caused by accidents, fire, natural calamities, or contamination.
    • Improper Use: Damage resulting from misuse, abuse, negligence, short circuiting, deep discharge, or overcharging (e.g., due to a faulty charger/inverter/vehicle charging system).
    • Unauthorized Service: Modification, disassembly, or repair of the Product by unauthorized persons.
    • Non-Approved Application: Use of the battery in an application or vehicle it was not designed or marketed for.
    • Maintenance Failure (if applicable): Failure to maintain electrolyte levels using pure distilled water (for flooded/tubular batteries).
6. Returns and Refunds
  • Return Policy (Non-Defective): Non-defective returns are accepted within 7 days of purchase, provided the Product is in its original, unused, and undamaged condition and packaging. A reasonable restocking fee may apply.
  • Defective Returns: The Buyer must return the Product to the Seller for warranty inspection. The Buyer is responsible for the shipping cost of the return to the Seller. If a valid manufacturing defect is confirmed, the Seller will cover the cost of shipping the replacement/repaired unit back to the Buyer.
7. Battery Safety and Environmental Compliance (MANDATORY DISCLAIMER)
  • Risk Acknowledgement: The Buyer acknowledges that batteries, particularly high capacity units, are hazardous goods and must be handled with extreme care.
  • Safety Precaution: Do not short-circuit the terminals, puncture the casing, expose the battery to fire or high heat, or attempt to open the sealed unit.
  • End-of-Life Responsibility: In compliance with the Batteries (Management and Handling) Rules, 2001 (as amended), it is the Buyer’s responsibility as a Consumer to ensure the used battery is not disposed of in household waste but is returned to the Seller, a recognized dealer, or a designated collection centre for recycling.
  • Liability: The Seller is not responsible for any damage, injury, or loss of life resulting from improper handling, charging, or disposal of the Product.
8. Limitation of Liability
  • To the maximum extent permitted by Indian law, the Seller’s total liability shall not exceed the purchase price of the Product.
  • The Seller disclaims liability for any indirect, consequential, or special damages, including loss of profit or business interruption, arising from the use or inability to use the Product.
9. Governing Law and Jurisdiction
  • These Terms shall be governed by and construed in accordance with the laws of India.
  • Any disputes shall be subject to the exclusive jurisdiction of the courts located in Aluva in India.
10. Sales, Installation & Service Territory Limitation
  • To ensure reliable delivery, support, and distributor coordination, the Seller restricts sales, installation, warranty service, and AMC service strictly to the following authorized regions and quotas: Kochi, Cuttack, Bhuvaneswar, Mumbai, Delhi.
  • Units transported, sold, or installed outside these areas will not be eligible for on-site support unless separately agreed in writing.
  • Quotas may be revised based on demand and distribution capacity.
